Terms of Service

1. User Consent to the TOS

You represent that you have read and agree to be bound by the TOS. You enroll in the Industry Intelligence SMS program by entering your mobile number, checking the separate SMS consent box, and submitting the SMS enrollment form. Providing a phone number elsewhere, or accepting other Industry Intelligence terms, does not by itself enroll you in SMS messaging.

2. Intellectual Property

(Standard IP clauses retained) The Service, including text, graphics, and messaging content, is protected by copyrights and trademarks. All rights in and to trade secrets, patents, and proprietary rights remain the sole property of Industry Intelligence.

3. Restrictions on Use

You may not use the Service for any illegal purpose. You agree not to use the Service in any manner that could compete with the business of Industry Intelligence. Specifically regarding messaging: You shall not use the Service to transmit any "junk mail," "spam," "chain letters," or "phishing" attempts. You are prohibited from sending messages that contain "S.H.A.F.T." content (Sexually Explicit, Hate Speech, Alcohol, Firearms, or Tobacco/Vaping).

4. A2P Brand and Messaging Terms (Carrier Compliance)

This section governs the Industry Intelligence SMS program. The program lets registered Industry Intelligence clients with an active subscription text questions about market intelligence topics (regulations, competitor activity, patents, and suppliers) to our number and receive research-based answers by SMS. Messages are sent only in response to your questions. Message frequency varies based on how often you use the service.

• User Opt-In: You opt in by checking the SMS consent box on our enrollment form at https://www.industryintel.com/legal/sms-optin and submitting the form. SMS enrollment is optional and is not a condition of purchasing or using your Industry Intelligence subscription.
• Message Frequency: The number of messages you receive may vary based on your interaction with the Service and your subscription preferences.
• Opt-Out (STOP): Text STOP to cancel at any time. Just text "STOP" to the short code or long code from which you receive messages. After you send STOP, we will send one message confirming you have been unsubscribed, and you will receive no further messages. Text START to resubscribe.
• Support (HELP): Text HELP for help or email clientcare@industryintel.com. If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance.
• Carrier Disclaimer: Carriers are not liable for any delayed or undelivered messages. This applies to all wireless carriers, including AT&T, T-Mobile, and Verizon.
• Message and Data Rates: As with all SMS services, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
• Privacy: How we handle your mobile number and opt-in data is described in our SMS Privacy Policy.

5. Registration and Account Creation

To access messaging features, you must provide accurate and updated registration information. You are responsible for maintaining the confidentiality of your account and for all activity occurring under your username.

6. Disclaimer and Limitation of Liability

The Service is provided "as is." Industry Intelligence makes no warranty regarding the timeliness or delivery of messages, as SMS delivery is subject to the limitations of wireless carrier networks.

7. Indemnification

You agree to indemnify Industry Intelligence against any claims arising from your use of the Service, including any claims related to the unauthorized use of a phone number not belonging to you during the registration process.

8. Governing Law

The TOS shall be governed by the laws of the United States and the State of California. Any disputes shall be resolved in the state and federal courts located in Los Angeles County, California.

3. Sharing and Disclosure of Information (SMS Privacy)

Industry Intelligence values your privacy. We do not sell, rent, or lease your personal information to third parties.

4. SMS Program Disclosures

This policy covers the Industry Intelligence SMS program, through which registered clients receive SMS answers to their market intelligence questions. Message frequency varies based on how often you use the service. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for help. The program terms are in our SMS Terms of Service.

5. Data Security

We implement appropriate technical and organizational measures to protect your data within the SMS environment. This includes encryption of data in transit and at rest, regular security assessments, and strict access controls to ensure your mobile data remains secure.

6. Your Rights and Choices

You have the right to:

• Access & Portability: Request a copy of the personal data we hold.
• Correction & Deletion: Correct inaccurate data or request deletion of your data.
• Opt-Out: You may opt out of SMS communications at any time by texting STOP to our number.
