Labels on Hershey's Syrup+Calcium, Syrup Sugar Free with Vitamin & Mineral Fortification products violate federal law, as company cannot use 'plus,' 'fortification' on labels because ingredients don't meet guidelines for claim, FDA says

LOS ANGELES , August 15, 2012 (Industry Intelligence Inc.) – The labels on Hershey Co.'s Syrup+Calcium, and Syrup Sugar Free with Vitamin & Mineral Fortification products constitute a violation of federal law, according to a Feb. 14 letter from the U.S. Food and Drug Administration to Hershey that was made public on Aug. 14, Reuters reported the same day.

According to regulatory guidelines, any products with the “fortification” and “plus” labels must contain a minimum of 10% of the reference daily intake for the specified minerals and vitamins or meet other conditions, which Hershey’s products failed to do, the FDA said.

Hershey’s has since resolved the matter, according to a company spokesperson. The word “fortification” has been dropped from the product formerly labeled as Syrup Sugar Free with Vitamin & Mineral Fortification, while the product labeled Syrup+Calcium has been changed to Syrup with Calcium.
