AFM Real Estate (AFMRE) is a subsidiary of American Forest Management, Inc., and is the exclusive agent for this transaction.  All information included and provided as part of the offering is for the potential bidders’ convenience only and is neither guaranteed nor warranted in any way by Seller, AFM Real Estate, or any of their respective affiliates or representatives.  The purchase of the timberlands shall be on an “AS IS” basis without representations or warranties of any kind or nature, including without limitation, legal or physical access to any portion of the timberlands, any warranty of marketability, harvestability, merchantability, quantity, quality, age, species mix, site classification, boundaries of the timberland included in the sale or fitness for a particular purpose.  All potential bidders acknowledge, understand and agree that any information, whether written or oral or whether in response to questions asked by potential bidders or third parties, or in the form of maps, surveys, inventory information, harvest projections and forecasts, plats, soil reports, engineering studies, environmental studies, inspection reports, inventory reports, plans, specifications, or any other information whatsoever, without exception, pertaining to the timberlands and the timber thereon, and any and all other matters concerning the condition, suitability, integrity, marketability, compliance with the law, or other attributes or aspects of the timberlands and the timber thereon is furnished to bidders solely as a courtesy and bidders shall not rely upon any such information provided by or on behalf of Seller, AFM Real Estate or any of their respective affiliates or representatives in the development of any binding bid.  Potential bidders should satisfy themselves as to the adequacy of all information prior to submission of their binding offer. Neither Seller, AFM Real Estate nor any of their respective representatives or affiliates have verified the accuracy of any statements or any other information contained therein or the qualifications of the persons preparing such information.  Seller reserves the right to reject any and all bids and to waive technical deficiencies in bids in its sole discretion.
