California judge prohibits Constellation Brands from selling Rosatello wine with specific packaging following complaint filed by San Antonio Winery in which company claimed packaging was too similar to its Stella Rosa product line

LOS ANGELES , March 13, 2014 (press release) – Court bars Constellation Brands from selling Rosatello wine in similar packaging

San Antonio Winery Inc. today announced that a legal injunction was granted yesterday prohibiting global giant, Constellation Brands, from selling its “Rosatello” wine with specific packaging that San Antonio claims is too similar to its popular “Stella Rosa” product line. The order by Judge Kronstadt of the U.S. Central District of California marks a significant milestone in the Los Angeles-based winery’s mission to protect the brand image of its “Stella Rosa” trademark.

San Antonio Winery first filed a complaint on August 30, 2013, contending that Constellation’s “Rosatello” line infringed “Stella Rosa’s” products and caused brand confusion among consumers. In a triumph for San Antonio Winery, the court entered an order on March 11th preliminarily enjoining Constellation’s use of the complained-of labels on its fizzy, low alcohol, sweet wine product.
