Hostess Brands files lawsuit against Kroger over US$2.84M in overdue invoices, alleges Kroger and subsidiaries have failed to make payments since July

LOS ANGELES , March 5, 2013 () – Hostess Brands Inc. has filed a lawsuit against The Kroger Co. over US$2.84 million in overdue invoices, Thomson Reuters reported March 5.

Hostess alleged in the lawsuit that Kroger and several of its subsidiaries have failed to make payments since July. Hostess is also asking a bankruptcy judge to disallow at least two legal claims levied by Kroger against Hostess until the company pays what it owes.

A spokesman for Kroger did not respond to a request for comment.
