Canada's National Energy Board begins hearing process to consider TransCanada's application to restructure pipeline services, tolling across its natural gas pipeline network, approve final Mainline tolls for 2012, 2013

CALGARY, Alberta , September 28, 2011 (press release) – The National Energy Board (NEB or the Board) today issued a hearing order starting the process to hear the application jointly filed by TransCanada PipeLines Limited, NOVA Gas Transmission Ltd. and Foothills Pipe Lines Ltd. (TransCanada).

In its application, TransCanada is asking the Board to consider restructured pipeline services and tolling across its pipeline network, which includes the Mainline, the Alberta System and the Foothills System. The Board is also being asked to approve final Mainline tolls for 2012 and 2013.

The Board recognizes that TransCanada's application is an important one for the future of the natural gas industry in Canada. Many of the issues raised in the application are complex and the Board expects that it will hear diverse views from many parties.

Industry participants will need the Board's decision on the application before they are able to make fully informed decisions. The Board recognizes that regulatory certainty is in the public interest.

The Board has already launched a process inviting interested persons to provide procedural suggestions that will allow for a fair and efficient process. A Pre-Hearing Planning Conference is scheduled to take place on Wednesday, 12 October 2011 at 9 a.m. in the Board's Hearing Room, 2nd Floor, 444 Seventh Avenue S.W., Calgary, Alberta. If necessary, the Conference will continue the next day.

The starting date for the oral public hearing of TransCanada's application will be determined following the Conference.

Members of the public can participate in the hearing in one of two ways:

i. by seeking intervenor status; or
ii. by filing a letter of comment.

Any person wishing to intervene in the hearing must file the required documents with the Board, and serve a copy on TransCanada by 19 October 2011. The Board will then release a List of Parties consisting of TransCanada and intervenors, and a final List of Issues. The deadline for letters of comment will be determined later.
