February 21, 2025 (press release) –
The Canadian Real Estate Association (CREA) stands behind every one of its more than 160,000 REALTOR® members in defence of the critical role they play in support of their clients and communities all across the country.
CREA is currently defending two ongoing class actions regarding compensation rules by private litigants in Canada (Sunderland and McFall).
We are aware RE/MAX has entered into some form of settlement with the plaintiffs in the Sunderland and McFall litigations. RE/MAX notes the settlement is a business decision to end the uncertainty associated with the litigation and not an admission of guilt, and that it continues to deny the allegations set out in the lawsuits. The settlement is subject to resolving a written settlement agreement and court approval.
“This news doesn’t change CREA’s own ongoing position and defence against these claims. We continue to believe they are without merit and remain committed to standing in support of our REALTOR® members.” says Janice Myers, CREA CEO.
CREA will continue to defend these actions alongside our co-defendants, who include boards and associations, franchisors, and brokerages.
